Due to ATF recently ruling that assembled M781 40mm training practice rounds ("chalk rounds") are considered Explosive Materials, requiring a Federal Explosives License to receive and be stored in an explosives magazine (see Ordnance Lab's video on the topic); TXMGO has changed the way we offer M781s. Now we will be offering them in a "kit" form, the assembling of which will legally be no different than mixing Tannerite. To do so, we will be shipping M781's without the 38 S&W blank that powers it, installed in the M781s. However the blanks are included with the package.
Under the regulations, the rounds only become "explosives" once the 38 S&W blank is inserted. Before the live cartridge is inserted, in the eyes of the ATF, the M781's hull and projectile is a paperweight and the blank is "small arms ammunition", exempt from federal explosive laws. Yet once the blank is inserted, due to it being over .50 caliber, it no longer falls under the small arms ammunition exemption to explosive laws, and has to be treated like explosives.
Before anyone gets too worked up about "manufacturing" explosives, rest assured (at the Federal level) it's perfectly legal to do without an FEL as long as you're doing it for your own personal use (state laws may vary). However once the rounds are assembled with the live blank on the inside, they are treated as explosives. That means if they are not immediately used, they have to be stored in an explosives magazine, and can't be transferred or transported without a Federal Explosives License.
What does this mean for you if you don't have an FEL? Not much really. All you have to do is not insert the blank in the M781 before you use it. That's it. No license, no paperwork, no black helicopters.
